In the United States, the law protects workers of all different kinds. In Minnesota, we use both the Americans with Disabilities Act (ADA), Title VII of the Civil Rights Act and Minnesota Human Rights Act. It is important to contact an attorney, whether through the Equal Employment Opportunities Commission or the Minnesota Department of Human Rights or a private attorney.
There are many different kinds of discrimination based on your disability. This might be a temporary or permanent disability.
Terminated from your employer because of your disability
Refused a reasonable accommodation
Refusal to let you take a reasonable leave for your disability
Reprisal for filing a complaint
Talking down to you or other behavior intended to humiliate, degrade or make you feel like you need to quit working at your employer.
Not hired for a specific job because of your disability
More than one of these areas might come into your case. Other types of law might also be able to help you, such as workers compensation if you obtained your disability while on the job. It is important to not limit yourself to one area of law and to not close any doors. You do not necessary need to obtain your disability on the job to qualify for disability discrimination.
If this sounds familiar to you, please be sure to contact me. Acting quickly is necessary to ensure that your rights are intact and that you meet any statute of limitations. It is much easier to deal with an employer that is misbehaving before they act and terminate you.
